美国宪法第五修正案当中有这么一款：“or shall private property be taken for public use, without just compensation.”没有充分补偿，私有财产不可以为公共使用而被征收。这个“just compensation”国内一般翻译为合理补偿，我觉得充分补偿更能体现其含义，所以折中，叫“合理，充分的补偿”，就是这么个意思。这个条款，说开了，就是这么个意思，政府不能征收私人财产，除非是为了公共利用的目的，还给够了拆迁补偿款，或者说只要是为了公共利用的目的，还给够了拆迁补偿款，那么就征收，也就是可以拆了。

在美国也有强拆
美国叫 Eminent Domain，也就是政府为了公共利益，可以强买私人的地。
这个本来是只能给公共设施的，但是前几年有一场打到了美国最高法院的官司决定了：目前，美国的地方政府可以强买私人的地皮，然后再转卖给其他开发商，以此带动当地经济。这个官司名字和编号为： Kelo v. City of New London, 545 U.S. 469 (2005)
我看了部分原文,的确是与强拆有关,尤其是这一段
In assembling the land needed for this project, the city’s development agent has purchased property from willing sellers and proposes to use the power of eminent domain to acquire the remainder of the property from unwilling owners in exchange for just compensation. The question presented is whether the city’s proposed disposition of this property qualifies as a “public use” within the meaning of the Takings Clause of the Fifth Amendment to the Constitution.1
